The Consumer Overdraft Items clause defines the terms under which a financial institution may allow transactions that exceed a consumer's available account balance, resulting in an overdraft. Typically, this clause outlines the types of transactions that may trigger an overdraft, such as checks, debit card purchases, or electronic transfers, and specifies any associated fees or limits. Its core practical function is to inform consumers about the circumstances in which overdrafts may occur and the financial implications, thereby ensuring transparency and helping consumers manage their accounts responsibly.
Consumer Overdraft Items.
A. Overdrafts in General. Account Overdrafts generally occur if you do not have sufficient funds available in your Account. Company does not permit Account Overdrafts on Consumer Accounts. We are not obligated to pay any Item presented for payment if your Account does not contain sufficient funds. Transactions will be denied if you have insufficient funds in your Account. We have no obligation to notify you before we deny a transaction for insufficient funds. If there is an Overdraft paid by us, you are responsible for any overdrawn balances and any associated fees. If there is an Overdraft paid by us on an Account with more than one Owner, each Owner, shall be jointly and severally liable for such Overdraft, plus any applicable fees. The amount of our Overdraft Item can be found on the applicable Fee Schedule.
B. Responsibility to Repay. You are responsible for any negative balances in your Account. This includes Overdrafts and anyassociated fees. If yourAccount remains negative for 60 days ormore, your Account may becharged off. If yourAccount is charged off it means the Account has a negative balance, is now closed and cannot be re-opened. Even though the Account is closed and charged off, you are still responsible for the negative balance. When an Account is charged off, we may reportyou to credit reporting agencies.This may impactyourabilityto open otherAccounts whetherwith us or at otherfinancial institutions. You authorize us to use the moneyfrom anysubsequent deposits toyourAccount to payany Overdraft and resulting fees. Subsequent deposits include any federal or state benefit paymentsthatyou choose to deposit in anyAccount (including Social Securitybenefits), if allowed by applicable law. You understand and agree that if you do not want your benefits applied in this way,you maychangeyourdirect deposit instructions at anytime. You agreeto payall costs and expenses we incur in collecting anyOverdraft. ▇▇▇▇▇▇▇▇▇▇ pursue collection oftheamountyouowe(including taking legal action againstyou) after it is chargedoff.
