Construction of Warranties Expressed in the Contract with Warranties Implied by Law. All warranties made by Contractor in all provisions of this Agreement and the Contractor’s Proposal, whether or not this Agreement specifically denominates Contractor’s promise as a warranty or whether the warranty is created only by Contractor’s affirmation or promise, or is created by a description of the Services to be provided, or by provision of samples to the Institution shall not be construed as limiting or negating any warranty provided by law, including without limitation, warranties which arise through course of dealing or usage of trade, the warranty of merchantability, and the warranty of fitness for a particular purpose. The warranties expressed in this Agreement are intended to modify the warranties implied by law only to the extent that they expand the warranties applicable to the Services provided by Contractor. The provisions of this section apply during the term of this Agreement and any extensions or renewals thereof.
