Common use of Construction Expenses Clause in Contracts

Construction Expenses. To Borrower’s knowledge, all costs and expenses of any and all labor, materials, supplies and equipment used in the construction maintenance or repair of the Improvements located on the CIGNA Mortgage Loan Property have been paid in full except as disclosed on Schedule XIV attached hereto. To Borrower’s knowledge, there are no claims for payment for work, labor or materials affecting the CIGNA Mortgage Loan Property which are or may become a lien prior to, or of equal priority with, the Liens created by the Loan Documents, the Senior Mezzanine Loan Documents and/or the Mortgage Loan Documents except those which have been insured over pursuant to the applicable Title Insurance Policy.
