Construction Delivery Method Clause Samples

The Construction Delivery Method clause defines the approach and process by which a construction project will be planned, managed, and completed. It specifies whether the project will use methods such as design-bid-build, design-build, construction management at risk, or other recognized frameworks, and outlines the roles and responsibilities of the parties involved under the chosen method. By clearly establishing the delivery method, this clause ensures all parties understand the workflow, risk allocation, and communication channels, thereby reducing misunderstandings and streamlining project execution.

Construction Delivery Method. The Design Professional will perform the services of this Agreement as a Management Team member and in conjunction with the Owner and Owner designated Project User Group. The intent of using a Management Team and collaborative design process is to produce quality and sufficient construction documents including plans and specifications that will facilitate efficient construction in a timely manner and represent the best value possible for the associated construction cost. The Design Professional will work jointly with the Owner and Owner’s Project User Group throughout all design Phases of work to evaluate the design, constructability, quality, value and costs and reach consensus decisions supporting the Project objectives. It is the intent of the Owner to have all construction documents one hundred percent (100%) completed prior to solicitation of competitive bids for construction contracting. As appropriate, the Design Professional may create construction documents to procure multiple bid packages for various components of the construction work and/or other services.
Construction Delivery Method. As outlined in the project contract documents, this project shall utilize a Construction Manager at Risk (▇▇▇▇), multiple bid packages, and phased delivery. Project Schedule/Phases/Milestones: BIM milestones, pre-design activities, major design reviews, stakeholder reviews, and any other major events which occur during the project lifecycle are outlined in the table below.
