Construction Account. No later than 2:00 p.m. Denver time on the date specified in each Notice of Borrowing, if the applicable conditions precedent listed in Article 3 have been satisfied or waived in accordance with the terms thereof and, subject to Section 2.1.7(d), to the extent Administrative Agent shall have received the appropriate funds from the Lenders, Administrative Agent shall make available the Construction Loans and Renegy Term Loans requested in such Notice of Borrowing (or so much thereof as shall have been determined pursuant to Section 3.6) in Dollars and in immediately available funds, and shall deposit or cause to be deposited the proceeds of such Construction Loans and Renegy Term Loans into the Construction Account.
