Conspiracy. Knowingly and willfully entering into a conspiracy to: (a) knowingly discharge and dispose in the navigable waters of the United States oily mixtures, including oily bilge water and slops from bilges, that accumulated in the machinery spaces of the Caribbean Princess without the operation of oily water separating equipment and oil content monitor, in violation of Title 33, United States Code, Section 1908(a) and Title 33, Code of Federal Regulations, Section 151.10(b)(4); (b) knowingly fail to maintain an accurate Oil Record Book in which all overboard discharges and disposals otherwise of oily mixtures, including oily bilge water and slops from bilges that accumulated in the machinery spaces of the Caribbean Princess were fully recorded in violation of Title 33, United States Code, Section 1908(a) and Title 33, Code of Federal Regulation, Section 151.25(d)(4); (c) knowingly conceal, cover up, falsify and make false entries in the Oil Record Book of the Caribbean Princess with the intent to impede, obstruct, and influence the investigation and proper administration of a matter within the jurisdiction of the United States Coast Guard and the Department of Homeland Security, and in relation to and in contemplation of such matter, in violation of Title 18, United States Code, Section 1519; and (d) knowingly obstruct agency proceedings, in violation of Title 18, United States Code, Section 1505, all in violation of Title 18, United States Code, Section 371. Conspiracy. ‌ Literary scholars have dissected The Crucible for decades. A majority of this criticism focuses on the witch trial’s effects, symbolism, and moral implications. Given its rather skeptical portrayal of Puritanism, many scholars find interest in the play’s morality and religiosity. Xxxxxx does not provide an explicit critique of Puritanism in the play, but Puritan codes foreground the action. Puritan values created strict absolutism in Salem. The Puritan theologian Xxxx Xxxxxxx said, “all men are divided into two ranks, either they are good or bad... there is no middle sort of men in the world.”1 Scholars consistently identify Salem’s absolutism, stressing the contentions it creates between accused and accuser. Xxxxxxx Xxxxxx notes “Puritan predestination...sweeps away any idea of degrees of good and evil.”2 This adherence to absolute morality results in a “construction of human pride [that] makes devils of the opponents of orthodoxy and destroys individual freedom.”3 Xxxx Xxxxxxx is a favorite of critics. As the main character of the play, Xxxxxxx is endlessly studied by literary scholars. Many interpret him a victim of guilt, seeing his downfall as a byproduct of his individual indiscretion. Xxxxxxxxxxx Xxxxxx notes Xxxxxxx’x guilt “renders him powerless,” saying it induces him to “belie himself.”4 This guilt is regularly expanded into a discussion of Xxxxxxx as Xxxxxx’x tragic hero. C.C. art. 2324, “[h]e who conspires with another person to commit an intentional or willful act is answerable, in solido, with that person, for the damaged caused by such act.” Furthermore, the actionable element of a conspiracy claim is not the conspiracy itself; rather, it is the tort that the conspirators agree to perpetrate and actually commit in whole or in part.   • Anti-Piracy In order to prevent theft, piracy, unauthorized retransmissions, redistribution or exhibition, copying or duplication of any Channel, in whole or in part, (hereinafter collectively referred to as “Piracy”), the IPTV Operator shall, prior to the commencement of the Term of the agreement and at all times during such Term, employ, maintain, and enforce fully effective conditional access system delivery and content protection and security systems, and related physical security and operational procedures (hereinafter collectively referred to as the “Security Systems”) as may be specified (security specifications), in a non-discriminatory manner in writing, from time to time, by ZEEL. The IPTV Operator shall comply with the Anti-Piracy Requirements set out in Clause VI and VII in ANNEXURE XII and also provide full and complete information for conducting Technical Audit by the auditors, empaneled by the Authority for conducting such audit, by furnishing details outlined in Clause I, II, III, IV and V of ANNEXURE XII attached herewith. The IPTV Operator shall deploy finger printing mechanisms to detect any piracy, violation of copyright and unauthorized viewing of the Channels, distributed / transmitted through its Platform at least every 10 minutes on 24 x 7 x 365(6) basis. The IPTV Operator shall not authorize, cause or suffer any portion of any of the Zee Group Channels to be recorded, duplicated, cablecast, exhibited or otherwise used for any purpose other than for distribution by the IPTV Operator at the time these Channels are made available. If the IPTV Operator becomes aware that any unauthorized third party is recording, duplicating, cablecasting, exhibiting or otherwise using any or all of the Zee Group Channels for any other purpose, the IPTV Operator shall within ten minutes of so becoming aware of such recording, duplicating, cablecasting, exhibiting or otherwise using any or all of the Zee Group Channels for any other purpose, notify ZEEL and the IPTV Operator shall also switch off the concerned Set Top Box to prevent such unauthorized use. However, use of a Set Top Box with Personal Video Recorder/ Digital Video Recorder facility which has been supplied by the IPTV Operator shall not be treated as unauthorized use, as long as such Set Top Box is used in accordance with the terms and conditions of the subscription agreement between the IPTV Operator and the subscriber. The IPTV Operator shall comply with the specifications for Set Top Box, Conditional Access System and Subscriber Management System as set out in ANNEXURE X attached herewith. If so instructed by Information (as defined below) by ZEEL, the IPTV Operator shall shut off or de-authorize the transmission to any unauthorized subscriber/ subscriber indulging in piracy, within ten minutes from the time it receives such instruction from ZEEL. Any communication under this Clause shall be considered as valid Information only if (i) the information is sent through e-mail in a format as mutually agreed by the parties and (ii) the information is sent by a person(s) who is designated to send such information. However, the “information” may even be provided by ZEEL representatives through other means of communications such as telephonic message, fax etc. and the said “information” shall later be confirmed by ZEEL through e-mail and the IPTV Operator shall be under obligation to act upon such information.

  • Collusion In the event of falsification of time records where it is established that both the employee and the Employer or his representative had knowledge of such falsification, the employee may be disciplined, and he shall be paid for all time worked by check mailed to the Union. In such cases, where an employee receives pay for work that was not recorded on the time report, a sum equal to that amount shall be paid by the Employer to the Health and Welfare Fund. All claims under this Section shall be limited to the ninety (90) day period immediately prior to the date the claim is presented to the Employer.

  • Assault Any case of assault upon a teacher which occurs in the line of duty shall promptly be 20 rights and obligations with respect to such assault, and its legal assistance to the teacher in 21 connection with handling of the incident by law enforcement and judicial authorities.
