Consignment Sales. Total consignment sales from forfeited collateral shall be split 75% to Member and 25% to Ballistics.
Consignment Sales. Notwithstanding the provisions of Section 2 and this Section 9, it is understood that Manufacturer may, as is common in the food industry, negotiate certain consignment arrangements for sales to club stores or Food Service accounts and Distributor will use its best efforts to distribute the Products to such outlets on a consignment basis, provided that consignment sales shall require the mutual agreement of the parties. In the event that the Distributor does not agree to any such consignment arrangement within 14 days after a reasonably specific presentation of the arrangement to the Distributor, then the Manufacturer shall have the right to arrange for other distribution for such consignment arrangement.
Consignment Sales. Debtor will obtain the Bank's written consent before making sales on consignment. For all consignment sales, Debtor will comply with Sections 9-114 (MCLA ss.440.9114) and 2-236 (MCLA ss.440.2326) so as to preserve the priority of Debtor's and the Bank's interest in the Collateral sold on consignment, over the interest of any consignee or creditors of any consignee.
Consignment Sales. Lazy Days agrees to use its best efforts to sell the recreational vehicles on a consignment basis. Any vehicles sold to Lazy Days by IA will be at manufacturer’s: invoice price without ▇▇▇▇ up. Any and all rebates and incentives will be passed through to Lazy Days.
