Consequential loss eExcluded liability. Except in relation to liability under as expressly provided in clauses 14.4, 17.5, and 17.12 and 17.15(b), 17.16(b), neither the Distributor party (nor the Retailer any of their respective officers, employees or agents) will be liable under or in connection with this agreement (whether in contract, tort (including negligence) or otherwise) to the other party for: (a) any loss of profit, loss of revenue, loss of use, loss of opportunity, loss of contract, or loss of goodwill of any person; or (b) any indirect or consequential loss (including, but not limited to, incidental or special damages); or
