Notwithstanding anything to the contrary contained in this Agreement, neither Party shall be liable to the other Party, whether in contract, tort, negligence, indemnity, strict liability, or otherwise, for any special, indirect, incidental, or consequential damages in connection with or arising out of the Work, or the performance, non-performance or breach of this Agreement.
