Conformity, Performance, and Compliance. NOVA represents and warrants (1) that all Deliverables shall be prepared in a workmanlike manner and with professional diligence and skill; (2) that all Deliverables will conform to the specifications and functions set forth in the Product Specifications relating thereto; and (3) that NOVA will perform the Phase I Development Work and the Phase II Product Development in compliance with applicable law.
