Conformances. During the Initial Warranty Period, if Licensee notifies Licensor of a Non-Conformance, Licensor, at its own expense, shall bring the Source Code version into substantial conformance with the appropriate RFC's as outlined in Schedule G of this Agreement. As set forth in Section 5.3, above, Licensor will support the Licensed Software in conjunction with the support and maintenance services set forth in Schedule E provided that the Licensee pays for such services after expiration of the Initial Warranty Period as outlined in Schedule E and Section 5.3 above.

It is the responsibility of the Contractor to plan his supply of documentation according to requirements and to indicate dates on the Accepted Programme.

Conformances. The Consultant shall maintain a non-conformity Register to indicate the status of all non-conformities, which are identified by the Engineer and the Consultant. The Consultant shall issue a written report to the Engineer on all non-conformity findings reported and the progression of these closures.

Conformances. The Buyer shall give QUBIG written notice of the existence of the damage or the defect of the Product within ten (10) days from the receipt of the Product. A failure by the Buyer to give such written notice within 10 (ten) days will constitute an absolute and unconditional waiver of such claim. QUBIG may supply new Products or refund the Price at its sole discretion.
