Conflicts/Interpretation Clause Samples
Conflicts/Interpretation. In the event of a conflict, contradiction, or ambiguity between or among any provisions included in any document comprising a part of this Agreement, and such conflict, contradiction or ambiguity has not otherwise been waived by the aggrieved party, the following order of precedence shall govern:
(1) Agreement text
(2) Attachment A – Scope of Work/Ordering Representatives
(3) Attachment B – Schedule of Rates and Payment Terms
Conflicts/Interpretation. If there is any conflict between provisions of this Agreement and provisions of the New Indenture, the provisions of the New Indenture shall control. Subject to the foregoing, the Agent may construe any ambiguous or inconsistent provision of this Agreement and any construction of a provision by the Agent shall be binding upon FNB Financial Services and FNB.
Conflicts/Interpretation. If there is any conflict between provisions of this Agreement and provisions of the Indenture, the provisions of the Indenture shall control. Subject to the foregoing, the Agent may construe any ambiguous or inconsistent provision of this Agreement and any construction of a provision by the Agent shall be binding upon FNB Financial Services and FNB.
