Common use of Conflicts Between Documents Clause in Contracts

Conflicts Between Documents. If any conflict or inconsistency exists between this Mortgage and the other Loan Documents, the terms of this Mortgage shall be controlling with regard to the Mortgaged Property (other than with respect to Deposit Accounts) and “as-extracted collateral” (as such term is used in the UCC), and otherwise the other Loan Documents shall control; provided that, notwithstanding anything herein to the contrary, in no event shall Mortgagor be under any obligation pursuant to the terms of this Mortgage to cure any title defect unless required to do so pursuant to the terms of the Credit Agreement.
