Condition Precedent to Each Utilization. The obligation of the Lender to permit any Utilization, including the first Utilization, shall be subject to the delivery to the Lender and Eximbank of the documents indicated below (each in form and substance satisfactory to the Lender and Eximbank) and to the fulfillment, as of the date of such Utilization (in a manner satisfactory to the Lender and Eximbank) of the conditions set forth below: (a) This Agreement, Guarantor Guarantee and Master Guarantee Agreement. This Agreement, the Guarantor Guarantee described in Section 3, the Master Guarantee Agreement and the Eximbank Approval each shall each continue to be in fall force and effect.
