Common use of CONDITION OF PREMISES ON MOVE-IN AND MOVE-OUT Clause in Contracts

CONDITION OF PREMISES ON MOVE-IN AND MOVE-OUT. a. Move-In – Tenant acknowledges that prior to occupying the Premises, Xxxxxx has examined the Premises and is satisfied with the condition. Xxxxxx agrees that Xxxxxx accepts the Premises “As Is” with “All Faults” without any warranty or guarantee expressed or implied by Landlord. Tenant shall have seven (7) calendar days from the Commencement Date to inspect the Premises and to complete the Move-In Checklist and return it to Landlord. Tenant is responsible to note thereon any conditions of the Premises that are not in a state of good repair and condition. Landlord reserves the right to refuse to accept a Move-In Checklist not returned to Landlord within 7 calendar days of Tenant’s occupancy and to review with Tenant any condition noted by Xxxxxx on the Move-In Checklist that Landlord questions. Landlord may, but is not required to, take pictures, videotape or otherwise document the condition of the Premises at the time of Tenant’s occupancy, as Landlord deems necessary or desirable. By accepting possession of the Premises, Xxxxxx acknowledges and agrees that the Premises is free of any damage or defect and no repair is required or requested other than as stated in the Move-In Checklist. Tenant acknowledges and agrees that the Move-In Checklist shall be conclusive and binding evidence of the condition of the Premises on the Commencement Date and is Xxxxxx’s acknowledgement and admission that the Premises is in a state of good condition and repair, except as stated on the Move-In Checklist. Tenant’s failure to complete and return the Move-In Checklist in a timely manner shall be deemed Xxxxxx’s acknowledgement and admission that the Premises was in a state of good repair and condition at the Commencement Date.
