Common use of Condition at Delivery Clause in Contracts

Condition at Delivery. LESSOR has advised LESSEE that at Delivery the Aircraft will be as set forth in Exhibit A and in the condition set forth in Exhibit B. To the extent that at Delivery there are non-substantial or minor deviations from the condition set forth in Exhibit B which do not affect the airworthiness of the Aircraft, LESSEE will nonetheless accept the Aircraft and LESSEE and LESSOR will adjust the return conditions of the Aircraft set forth in Article 23 accordingly.

Condition at Delivery. LESSOR has advised LESSEE that at Delivery the Aircraft will be as set forth in Exhibit A and in the condition set forth in Exhibit B. To the extent that at Delivery there are non-substantial or minor deviations from the condition set forth in Exhibit B which do not affect the airworthiness of the Aircraft, LESSEE will nonetheless accept the Aircraft [Redacted] and LESSOR and LESSEE and LESSOR will adjust the return conditions of the Aircraft set forth in Article 23 22 accordingly.

Condition at Delivery. LESSOR has advised LESSEE that at Delivery the Aircraft will be as set forth in Exhibit A and substantially in the condition set forth in Exhibit B. To the extent that at Delivery there are non-substantial or minor deviations from the condition Aircraft is not substantially different than as set forth in Exhibit B which do not affect the airworthiness of the AircraftB, LESSEE will nonetheless accept the Aircraft and but LESSEE and LESSOR will adjust record such discrepancies on the Estoppel and Acceptance Certificate and the return conditions of the Aircraft set forth in Article 23 accordinglywill be deemed amended in a corresponding fashion.
