Common use of Computation of Earned Discount Clause in Contracts

Computation of Earned Discount. In making any determination of Earned Discount, the following rules shall apply: (a) no provision of this Agreement shall require the payment or permit the collection of Earned Discount in excess of the maximum permitted by Applicable Law; and (b) Earned Discount for any period shall not be considered paid by any distribution if at any time such distribution is rescinded or must otherwise be returned for any reason.
