Complying with Performance Standards. The Entity agrees to meet the performance standards outlined in section II.B. The Entity will submit data to KDHE-DHCF upon request to be used by KDHE-DHCF to monitor the Entity’s compliance with the performance standards. If KDHE-DHCF determines that the Entity is not meeting the specified standards, KDHE- DHCF will notify the Entity and initiate a process to assist the Entity in meeting the standards. As noted in section II. B., KDHE-DHCF will provide the Entity with additional training, assist the Entity in developing and implementing a corrective action plan, and provide the Entity with a reasonable period to come into compliance with the standards. If the Entity remains unable to meet the standards after being given a reasonable and appropriate opportunity to do so, KDHE-DHCF may terminate this Agreement, as described in Section VI.
