The Company’s disclosure in the Prospectus with respect to the status of its products under the rules and regulations of the United States Food and Drug Administration (“FDA”), the Federal Trade Commission (“FTC”), Canada’s Medical Devices Bureau of the Therapeutic Products Directorate (“MDB”) and the Health Products and Food Branch Inspectorate of Health Canada, including the FDA’s Federal Food, Drug and Cosmetic Act, the FTC’s Federal Trade Commission Act and the MDB’s Medical Devices Regulations, is accurate and complete in all material respects.
