Compilations. For purposes of this Section, Deliverables and Work Products that contain Contractor Technology will be deemed to be compilations as defined in 17 U.S.C. § 101 and will be owned by the Department as provided in 17 U.S.C. § 103(b), and the underlying pre-existing materials and Contractor Technology included in the Deliverables and Work Product will remain owned by Contractor and its suppliers.
Compilations. If a composition from the Master Recording is used on a compilation or recording in which other artists are included, the Artist' royalty shall be pro rated. For example, if a composition from the Master Recording is included on a compilation containing nine selections from other artists, Artist shall be entitled to one-tenth (1/10th) of the royalty rate. Flat Fee. Company shall pay Artist _____% of the net receipts paid to Company under any flat fee license of the Master Recordings or any portion of the Master Recordings. Promotional Recordings and Cutouts. No royalties will be due on Records furnished on a promotional basis. Nor shall any royalty be due for Records sold by Company as cutouts or for scrap or otherwise upon deletion from Company's catalogue.
Compilations. Subject to this Article 19, Client acknowledges and agrees that Service Provider may develop various reports, surveys and data compilations, (collectively, “Compilations”) relating to its services and Service Provider may include data relating to its Services under this Agreement, including Client Data, subject to the following terms:
Compilations. 12.2.1 In consideration of the Limited Use Compilation Programme Fee payable to each Musician, Producer shall be entitled to incorporate compilations into a Compilation Programme and to use, exploit or licence others to use the Work(s) for non-theatrical use worldwide and one of the mediums and territories set out in clause 10.1.1 and Further Rights in accordance with clause 11.
Compilations vii) An ITV Company wishing to use extracts in a compilation programme i.e. a programme substantially made up of extracts celebrating the work of an Artist or Musician or an established group of Artists or Musicians or a known production series shall make the following payments to each Musician:
Compilations. The ROH may use or license extracts from any of the AV or AO Recorded Productions above to be re-packaged for inclusion in compilation products in any of the media formats covered by this Media Agreement and for publicity/promotional purposes to enhance the public presentation of ROH cinema and Big Screen transmissions.

  • Data The information set forth in the related Mortgage Loan Schedule, including any diskette or other related data tapes sent to the Purchaser, is complete, true and correct in all material respects. The information on the Mortgage Loan Schedule and the information provided are consistent with the contents of the originator's records and the Mortgage File. The Mortgage Loan Schedule contains all of the required fields. Any seller or builder concession has been subtracted from the Appraised Value of the Mortgaged Property for purposes of determining the LTV and CLTV. Except for information specified to be as of the origination date of the Mortgage Loan, the Mortgage Loan Schedule contains the most current information possessed by the originator. No appraisal or other property valuation referred to or used to determine any data listed on the Mortgage Loan Schedule was more than 3 months old at the time of the Mortgage Loan closing.

  • Computer The Contractor shall maintain at its office for its use a computer with, at a minimum, a 1 GHz processor and an internet connection. The Contractor shall maintain individual email accounts for each of its project managers.

  • Personnel Information Employee shall not divulge or discuss personnel information such as salaries, bonuses, commissions and benefits relating to Employee or other employees of Employer or any of its subsidiaries with any other person except the Executive Committee and the Board of Directors of Employer.

  • Photographs TENANT hereby gives LANDLORD permission to take photographs during LANDLORD hosted functions or activities which may then be used for the community newsletter, bulletin board, website, or other publications for marketing purposes. TENANT gives your permission to LANDLORD to use any photograph or photographic image including video or video stills taken of you while you are in any public spaces, grounds, offices at the PROPERTY or any Community sponsored events in the Community or otherwise. You understand that your photograph or photographic image will be used for nothing other than legitimate business purposes. You hereby grant State on Campus Tuscaloosa and LANDLORD and assigns, those acting with its authority and permission, the irrevocable and unrestricted right and permission to copyright, in its own name or otherwise, and use, re-use, publish, and re-publish photographic or video portraits or pictures of you or in which you may be included, in whole or in part, or composite or distorted in character or form, without restriction as to changes or alterations, in conjunction with your own or a fictitious name, or reproductions thereof in color or otherwise, made through any medium, and in any and all media now or hereafter known for illustration, promotion, art, editorial, advertising, trade, or any other legal purpose whatsoever. You also consent to the use of any printed matter in conjunction therewith. You hereby waive any right that you may have to inspect or approve the finished product and the advertising copy or other matter that may be used in connection therewith or the use to which it may be applied. You hereby release, discharge, and agree to hold harmless State on Campus Tuscaloosa and LANDLORD and assigns, and all persons acting under its permission or authority from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form, whether intentional or otherwise, that may occur or be produced in taking said picture or in any subsequent processing thereof, as well as any publication forever discharge State on Campus Tuscaloosa and LANDLORD, its officers, employees, attorneys, representatives, insurers and assigns from any and all demands, cause of action and/or judgments of whatsoever nature of character, past or future, known or unknown, whether in contract or in tort, whether for personal injuries, property damage, payments, fees, expenses, accounts receivable, credit, refunds, or any other monies due or to become due, or damages of any kind or nature, and whether arising from common law or statute, arising out of, in any way, the use of your photograph or photographic image. This release contains the entire agreement on this subject matter between the parties and will be binding upon and inure to the benefit of the successors and assigns of the undersigned.

  • MANUALS Each product delivered under contract to any Customer must be delivered with at least one (1) copy of a safety and operating manual and any other technical or maintenance manual. The cost of the manual(s) must be included in the price for the Product offered.

  • Reproductions This Agreement and all documents which have been or may be hereinafter furnished by Borrower to the Bank may be reproduced by the Bank by any photographic, photostatic, microfilm, xerographic or similar process, and any such reproduction shall be admissible in evidence as the original itself in any judicial or administrative proceeding (whether or not the original is in existence and whether or not such reproduction was made in the regular course of business).

  • Processes Any employer, employee, trade union or employer’s association may at any point in time apply for an exemption from any of the provisions of this Collective Agreement. The applicant is required to complete and submit in writing with the relevant office of the Council, a fully and properly completed prescribed application for exemption form, accompanied by all relevant supporting documentation.

  • Discoveries Any and all inventions, discoveries, improvements, designs, methods, systems, developments, know how, ideas, suggestions, devices, trade secrets and processes (collectively, “Discoveries”), whether patentable or not, which are discovered, disclosed to or otherwise obtained by Executive during Executive’s employment with the Company, are confidential, proprietary information and are the sole and absolute property of the Company. Executive shall immediately disclose and hereby assigns to the Company all such Discoveries and shall assist the Company in making any application in the United States and in foreign jurisdictions for patents of any kind with respect thereto. Whenever requested to do so by the Company, Executive shall execute any and all applications, assignments, or other instruments that the Company may deem necessary to protect the Company’s interest therein. Notwithstanding the fact that the Company may request additional assignment and assistance in applications, the assignments made in this Section 8 are adequate to cause an assignment of Executive’s interest in any Discoveries.

  • Firmware and software used for operation and maintenance reporting. Notwithstanding the foregoing, Enova will make reasonable efforts to resolve firmware or software problems.
