Competing Users Clause Samples
The Competing Users clause defines how a landlord manages situations where multiple tenants or users have interests that may overlap or conflict within the same property or facility. Typically, this clause outlines the landlord's rights to lease space to other tenants, even if their businesses are similar or directly compete with an existing tenant, and may specify any limitations or exceptions, such as exclusive use rights. Its core function is to clarify expectations and reduce disputes by addressing potential competition among tenants, thereby allocating risk and ensuring transparency regarding the landlord’s leasing practices.
Competing Users. Wireless Provider accepts the risk that City and others (the “Competing Users”) may now or in the future install their facilities in the Use Areas in locations that make parts of the Right-of-way unavailable for Wireless Provider’s use.
Competing Users. Water/waste/storm pipes, pavement, fiber, telephony, electric lines, cable and other facilities may all be located within the same segment of ROW with portions of the Facilities. WANRack accepts the risk that the City and others (the “Competing Users”) may now or in the future install their facilities in the Use Areas in locations that make parts of the ROW unavailable for WANRack’s use. The Competing Users include without limitation, the City, the State of Arizona and its political subdivisions, the public, and all manner of utility companies and other existing or future users of the Use Areas.
Competing Users. Without limitation, Licensee acknowledges and accepts the risk that the City and/or others ("Competing Users") may now or in the future use the Use Areas in a manner inconsistent with Licensee's use. The Competing Users include without limitation the City, the State of Arizona, any political subdivision, the public, and all manner of public utility companies and other existing or future users of the Use Areas.
