Competent Workers Sample Clauses

The 'Competent Workers' clause requires that all personnel assigned to perform work under the contract possess the necessary skills, qualifications, and experience to carry out their duties effectively. In practice, this means the contractor must ensure that employees or subcontractors are properly trained and capable of meeting the standards expected for the project, such as using specialized equipment or adhering to safety protocols. Competent Workers. Contractor shall employ and cause each Subcontractor to employ competent, appropriately trained, and experienced employees for the Services to be performed. Contractor shall have full responsibility for the conduct of all employees employed on or in connection with the Services (including employees of any Subcontractor) and will ensure that there is adequate, daily supervision of all Services. Contractor shall be familiar with and observe established and accepted labor practices, procedures, and project agreements.

Contractor shall keep on the job throughout its duration a competent superintendent and adequate staff and assistants as necessary for the proper administration and performance of the Work, and the superintendent and key members of the Contractor’s staff shall not change without the prior consent of the Construction Manager. The superintendent or other key staff member who is competent to perform supervision of the Work shall be present at all times during the performance of the Work, including, without limitation, during double or second shift or overtime performance of the Work.
