Compensatory Time Option. With authorization of the department and the employee, an employee may elect to be compensated for overtime or holiday work in the form of compensatory time off rather than pay. Such election must be made in advance, either on a standing or ad hoc basis. Either party may require that overtime be compensated in pay. Such compensatory time off may be accumulated to a maximum of eighty (80) hours. Unused compensatory time shall be paid off at the employee's regular rate at the time of termination or transfer to another department.

Employees shall be allowed to utilize accrued compensatory time at any time unless it can be demonstrated that the time off will impair the operations of the College. Compensatory time off may be scheduled by the employing official during the final sixty (60) days of a year. Employees who earn compensatory time off by working during commencement will attempt to schedule time off prior to the end of the fiscal year, but if unable to do so will receive overtime pay.

Compensatory Time Option. The parties recognize that compensatory time (comp time) is a form of payment for overtime. Time will accumulate at the rate of one and one-half (1 1/2) hours for each overtime hour worked or according to Holiday compensation as specified in Article 22. When an Employee works overtime, the Employee, at his or her discretion, may choose whether to take comp time or receive overtime pay. Comp time shall only accumulate up to a total of eighty (80) hours. Comp time hours may be taken in multiples of two (2) hours and will require the prior approval of the Director or his or her designee. Such approval shall not be unreasonably denied. However, in certain circumstances the Director, in his sole discretion, may grant comp time usage of a shorter duration. Unused comp time shall be paid at the current rate of pay, and at an employee’s option up to forty (40) hours of comp time may be paid out any time during the calendar year provided the Employer is provided at least two (2) weeks’ notice and based on Department budget constraints. Unused comp time may be carried over from year to year. Upon separation from service with the Gallia 911 Center for any reason, Employees shall be paid at their current rate of pay for all accumulated but unused hours of comp time. When an Employee dies while in paid status in the County service, any accumulated but unused comp time to his or her credit shall be paid in a lump sum to the surviving spouse or to the estate of the deceased.
Compensatory Time Option. In situations where it is determined to be in the best interests of the Employer (which may also include training and/or schools) the Employer shall grant compensatory time off in lieu of overtime payment at a rate of time and one half. In such situations, compensatory time shall be granted at such times and in such time blocks as are mutually agreed upon between the involved employee and the Fire Chief; permission to utilize compensatory time shall not be unreasonably denied by the Fire Chief, if operating requirements will not be adversely affected. Employees who do not use accumulated compensatory time by the end of the calendar year, and with permission of the Fire Chief, shall be permitted to carry over to the next year unused compensatory hours.

Compensatory Time Option. It is the employee's option to accrue the equivalent hours of overtime as compensatory time at the rate of one and one-half (1-1/2) time. Except, any overtime earned while working in a division other than the employee's own shall be paid at the rate of one and one-half (1-1/2) times his hourly rate. It is the City's position to allow the accrual of compensatory time to provide the employees with additional leave time throughout the year in which the time is accrued. Therefore, any accrued Compensatory Time remaining on the books at the end of November of any given year will be paid with the first pay period in December. The time will be paid at the rate of the employee's straight time hourly rate since the compensatory time was accrued at one and one-half (1-1/2) times the number of hours worked.
Compensatory Time Option. An employee may elect to accrue any hours required to be paid at an overtime rate as compensatory time off at the time and one-half rate to a maximum accrued balance of fifty (50) hours, to be scheduled (in accordance with Fair Labor Standards Act requirements) at a time mutually approved by the employee and the Sheriff or their designee, and to be used in increments of tenths of an hour, and will be calculated and reported in the same manner as Section 9.1. At the time of the overtime when the employee selects the compensatory option the employee will be subject to the restrictions that an employee may not accrue more than a total of fifty (50) hours of compensatory time at any time under any circumstances. Whenever an employee works any overtime that would result in the employee’s exceeding a total of fifty (50) hours of accrued compensatory time, the employee shall be paid for that overtime at the overtime rate (as provided by applicable federal and state laws), whether or not the employee had advance notice of the amount of compensatory time the employee had accrued.
