Compensation For Changes. Before commencing any services for which a Change in Services will be requested, the Contractor shall provide the Owner with a written proposal to provide such services on the basis of a fixed fee or, if the scope of the change cannot be sufficiently determined, on the basis of the Contractor’s hourly rates plus Subcontractor Costs up to an NTE Fee (as set forth in Section 7.1(b)). Upon receipt of the Contractor’s written proposal, the Owner may, in its sole and absolute discretion, accept the requested change by issuing a Change in Services to the Contractor or reject the requested change and require the Contractor to proceed with the Services as designated by the Owner.
