Compensation for Basic Design Services Sample Clauses
The "Compensation for Basic Design Services" clause defines how and when the design professional will be paid for their standard design work under the contract. Typically, this clause outlines the fee structure—such as lump sum, hourly rates, or percentage of construction costs—and specifies the payment schedule, like monthly invoicing or milestone-based payments. By clearly establishing the terms of payment for basic services, this clause ensures both parties understand their financial obligations and helps prevent disputes over compensation during the project.
Compensation for Basic Design Services. The Design Professional agrees to perform for the Owner the work and the professional services hereinbefore denominated as Basic Design Services. The Owner agrees to pay the Design Professional for such services a LUMP SUM FEE specified in the Contract, hereinafter known and referred to as the "Basic Design Services Fee." The Basic Design Services Fee shall include all professional Basic Design Services for design (Schematic Design, Design Development, Construction Documents, Bidding Phases Services) and the design of all Change Orders during the Construction phase that are not a result of a Change of Scope. Compensation for services related to Change Orders that result from a Change of Scope shall be in accordance with Contract Paragraph 4e. If the Owner does not elect to procure construction services, then there shall be no payment for construction procurement services.
Compensation for Basic Design Services. The fee for Basic Design Services is based on a percentage of the MACC. The MACC, for the purpose of calculating the fee for Basic Design Services, shall not be adjusted at the time of the Construction Contract Award. If at any time the MACC and/or percentage is changed by amendment to the A/E Agreement, the Basic Design Service fee shall be adjusted as appropriate. No fee adjustment shall be made for phases already completed.
