Company Defined. “Company” shall mean Tidewater Inc. (as heretofore defined), and shall include any successor to or assignee of (whether direct or indirect, by purchase, merger, consolidation or otherwise) all or substantially all of the assets and/or business of the Company which assumes and agrees to perform this Agreement by operation of law, or otherwise.
