Common use of Community Relations Clause in Contracts

Community Relations. 33.1 Navy shall develop and implement a Community Relations Plan. This plan responds to the need for an interactive relationship with all interested community elements, both on and off the Facility, regarding environmental activities conducted pursuant to this Agreement by Navy. Any revision or amendment to the Community Relations Plan shall be submitted to EPA, Interior or the Commonwealth for review and comment. In formulating this plan, Navy shall consider utilizing as appropriate, in whole or in part, any existing community relations plans that may exist for various portions of the Site. 33.2 Except in case of an emergency requiring the release of necessary information, and except in the case of an enforcement action, any Party issuing a press release with reference to any of the Work required by this Agreement shall use its best efforts to advise the other Parties of such press release and the contents thereof prior to issuance of such release. 33.3 The Parties agree to comply with all relevant EPA policy and Guidance on community relations programs and the public participation requirements of CERCLA, the NCP, and other laws and regulations. 33.4 The Parties agree that Work conducted under this Agreement and any subsequent proposed RA alternatives and subsequent plans for RA at the Site arising out of this Agreement shall comply with all the Administrative Record and public participation requirements of CERCLA, including CERCLA Sections 113(k) and 117, 42 U.S.C. §§ 9613(k) and 9617, the NCP, and all applicable Guidance developed and provided by EPA. 33.5 The Information Repository is located at Biblioteca Electronica, ▇▇▇▇▇ ▇▇▇▇▇▇ ▇▇▇▇▇▇ #449 ▇▇▇▇▇▇ ▇▇, Vieques, PR 00765. Navy has established and is maintaining an Administrative Record file at or near the Site and has made it available to the public in accordance with CERCLA Section 113(k), 42 U.S.C. § 9613(k), Subpart I of the NCP, and applicable Guidance issued by EPA. The Administrative Record developed by Navy shall be periodically updated and a copy of the Index will be provided to EPA, Interior, and the Commonwealth. Navy will provide to EPA, Interior, or the Commonwealth on request any document in the Administrative Record.

The Navy has established and is maintaining an Administrative Record file at or near the Site and has made it SJCA (Major ▇▇▇▇▇▇▇ Library in Chesapeake, Virginia) available to the public public, and another copy at a central location, in accordance with CERCLA Section 113(k), 42 U.S.C. § Section 9613(k), Subpart I of the NCP, and applicable Guidance issued by the EPA. The Administrative Record developed by the Navy shall be periodically updated and a copy of the Index will be provided to EPA, Interior, the EPA and the CommonwealthVDEQ. The Navy will provide to EPA, Interior, or the Commonwealth EPA and the VDEQ on request any document in the Administrative Record. 34.6 Pursuant to 10 U.S.C. Section 2705(d) and Section XXXVI - RESTORATION ADVISORY BOARD of this Agreement, the Navy has established a Restoration Advisory Board (RAB) for SJCA in 1994. The purpose of the RAB is to afford a forum for cooperation between the Parties, local community representatives, and natural resource trustees on action and proposed actions at the Site.

The Air Force shall have primary responsibility for implementation of the CRP, subject to oversight by EPA and subsequent plans the State. 25.3 In accordance with requirements of CERCLA Section 117(d), 42 U.S.C. 9617(d), a public information repository shall be established at or near Pease AFB for RA public inspection. The Air Force shall place all primary documents as listed in Section XV, Deadlines, in the information repository upon finalization and release for comment. This repository may be maintained at the Site arising out of this Agreement shall comply with all same location as the Administrative Record and public participation requirements of CERCLA, including CERCLA Sections 113(k) and 117, 42 U.S.C. §§ 9613(k) and 9617, the NCP, and all applicable Guidance developed and provided by EPAwhich will be located at or near Pease AFB pursuant to Section 25.4. 33.5 25.4 The Information Repository is located at Biblioteca Electronica, Air Forc▇ ▇▇▇ll establish and maintain an Administrative Record at two locations. As such, the Sheriff himself/herself would like to be notified of concerns a citizen has with the agency. The Sheriff may look into it or assign proper personnel to look into concerns regarding community relations. 1. The Sheriff will hold an annual meeting with the citizens and participants in this agreement to review any changes, take any suggestions, and to continually work with the community for the upkeep of this community agreement so that it fulfills the needs of the current day. 2. The ▇▇▇▇▇▇▇ #449 County Sheriff’s Office will hold their officers accountable on and off duty according to ▇▇▇▇▇▇▇ County Sheriff’s Office policies. 3. The ▇▇▇▇▇▇▇ County Sheriff’s Office will continue to develop and support community-based programs in a focused effort to enhance and increase communication, Viequesstrengthen existing relations, PR 00765and build new relationships with the community, inclusive of those groups represented in this Agreement. Navy has established and is maintaining an Administrative Record file at or near When possible, the Site and has made it available ▇▇▇▇▇▇▇ County Sheriff’s Office will engage with the community to ensure these programs are developed with sensitivity to the public in accordance with CERCLA Section 113(k), 42 U.S.C. § 9613(k), Subpart I specific needs of the NCPcommunity. 4. The ▇▇▇▇▇▇▇ County Sheriff’s Office will review policies for the risk of disparate racial treatment. 5. The community organizations who have signed this Agreement will support reasonable and appropriate efforts of the ▇▇▇▇▇▇▇ County Sheriff’s Office to implement this Agreement. 6. Organizations and individuals acting as advocates for complainants are expected that they will neither comment nor release any information of alleged Sheriff’s misconduct until it has been first reported to the Sheriff’s Office. Before either the organization acting as a contact point or the Sheriff’s Office releases any information, both parties will meet and confer regarding the nature of any such releases. 7. The organizations and individuals who are party to this Agreement agree to participate in efforts to educate the community relative to Sheriff’s policies, procedures and other pertinent issues. If able, the organizations will acknowledge participation in this Agreement on websites, social media, and applicable Guidance issued by EPAother media platforms. The Administrative Record developed by Navy shall be periodically updated and a copy of the Index will be provided to EPATo assist in this process, Interior, ▇▇▇▇▇▇▇ County Sheriff’s Office and the Commonwealth. Navy county will provide to EPA, Interior, or the Commonwealth make this Agreement readily available on request any document in the Administrative Recordall appropriate media platforms.

Before the Effective Date of this Agreement, the Air Force established and began maintaining copies of an Administrative Record at two locations: 1) 87th CES/CEAN, Building 2403, ▇▇▇▇▇▇▇ Air Force Base, New Jersey, 08641; and, the Burlington County Library, ▇ ▇▇▇▇▇▇▇ ▇▇▇▇., ▇▇▇▇▇▇▇▇▇▇▇, ▇▇▇ ▇▇▇▇▇▇, ▇▇▇▇▇. The Administrative Record developed by Navy the Air Force shall be periodically updated and a copy of the Index will be provided to EPA, Interior, and the Commonwealth. The purpose of the RAB is to provide a forum for cooperation between the Parties, local community representatives, and natural resource trustees on actions and proposed actions at the Site. The Parties shall participate in the RAB as follows: 33.6.1 A ▇▇▇▇▇▇▇ AFB representative who shall co-chair the RAB; 33.6.2 A local citizen who shall co-chair the RAB; 33.6.3 The EPA Project Manager(s); 33.6.4 A NJDEP representative; and 33.6.5 The Air Force Project Manager(s). The Parties shall encourage representatives from the following organizations to serve as members of the RAB: 33.6.6 The local communities of Pemberton Township, ▇▇▇▇▇▇▇ Township and Plumsted Township. 33.7 The ▇▇▇▇▇▇▇ AFB RAB Co-chair shall schedule quarterly meetings of the RAB unless the Parties agree to meet more or less frequently. Meetings shall be for the purpose of reviewing progress under the Agreement and for the following purposes: 33.7.1 To facilitate early and continued flow of information between the community, ▇▇▇▇▇▇▇ Air Force Base, and the environmental regulatory agencies in relation to restoration actions taken by ▇▇▇▇▇▇▇ Air Force Base under the Installation Restoration Program; 33.7.2 To provide an opportunity for RAB members and the public to review and comment on actions and proposed actions under the Installation Restoration Program; and 33.7.3 To facilitate regulatory and public participation consistent with applicable laws. 33.8 Special meetings of the RAB may be held at the request of the members.
