A Common Drive Easement clause establishes the legal right for multiple property owners to use a shared driveway or access road. Common Drive Easements. Each Owner, for itself and its respective successors and assigns, hereby establishes and grants a perpetual, appurtenant, non-exclusive, reciprocal easement on, under, over and across that portion of the Common Drive situated on such Owner’s Lot following initial construction, for the benefit of all Owners and their respective franchisees, tenants, invitees, guests and licensees (each a “Permittee” and collectively the “Permittees”), for vehicular and pedestrian ingress and egress, and for the performance of the Common Drive Maintenance (as defined below), on the terms and conditions set forth herein (the “Common Drive Easements”). “Common Drive” as used herein shall mean the shared drive as shown on the Approved Plans, including but not limited to any and all paving, curb, gutter, median and sidewalk improvements, and any other hardscaping and landscaping improvements associated with the Common Drive located on such Owner’s Lot. A portion of the Common Drive includes the Private Drive (as defined in the 2010 Declaration) in its entirety.
