Commitment to Sustainability. (A) LEED Rating System The Developer agrees that it will design and build the shell and core of the Building to meet certification under the Leadership in Energy and Environmental Design (“LEED”) Green Building Rating System developed by the United States Green Building Council at the Silver Standard level, based upon the criteria existing as of the Effective Date, provided, however, that the City agrees that no provision of this Agreement shall require the Developer to actually apply for and/or be granted such certification.
Commitment to Sustainability. The City and the Developer agree that promoting environmental sustainability and alternative modes of transportation are critical to the success of the Project as well as the future success of New Haven as a whole. Therefore, the Developer shall use its best efforts, subject to cost considerations in the Developer's commercially reasonable discretion to construct the buildings in accordance with the Leadership in Energy and Environmental Design ("LEED") Green Building Rating System, Silver Standard, developed by the United States Green Business Council (as the same may be defined as of the Effective Date or at the time of construction.
Commitment to Sustainability. All participating partners to this agreement have committed to a strategy of creating a better life for all, not just for today, but for future generations to come. To do this, we must use finite resources in an efficient way, without waste, and protect the natural environment to enhance the ability of future generations to maintain and improve their lives. Within the social housing context, Consortium members recognise that sustainable development has a strong social dimension and that it is important to create and maintain communities that will thrive. We want to provide homes which remain desirable to our residents well into the future, with low running costs, and this requires the support of good quality, cost-effective goods and services that meet not only their current requirements, but also their longer-term needs and aspirations. This therefore requires us to consider the environmental, economic and social impact in all that we do. Anglian shall work with Consortium members and its purchasing partners to support this strategy and its supporting policies, and to demonstrate an active commitment to:- providing windows with a ‘U’ value of 1.4 W/m2/K (and an Energy Efficiency Rating of ‘A’) at the best possible price; supporting the Code for Sustainable Homes targets on new homes; tackling the fuel poverty agenda; supporting the use of frames and glazed units that are manufactured in the EU; effective environmental site management; waste management and recycling; reduction of waste to landfill; supporting each purchasing client’s existing environmental policies. Commitment to Sustainability. Walnut agrees that all Walnut Projects developed within the UC-MU District will be developed to LEED Standards, and that the project, once complete, will obtain LEED Certification. Should a Walnut Project fail to obtain LEED Certification, Walnut agrees to pay a penalty to the City in accordance with the standards set forth in Section 925.06.E of the City of Pittsburgh Zoning Code.
Commitment to Sustainability. (a) Consistent with the Board of Alders’ Resolution Endorsing the Declaration of a Climate Emergency to Restore a Safe Climate, adopted on September 3, 2019, the Developer will take a climate awareness approach to the rehabilitation and construction of the Project Buildings, with a view to long-term responsiveness to climate change. In particular (but without limitation) the Developer shall undertake such carbon reduction measures as may be feasible, including (without limitation) the installation of roof top solar arrays to generate zero carbon electricity, to the extent provided in Section 4.5(e) below.
(b) The Developer agrees that the Developer shall design and build the systems serving the Project Buildings (mechanical or electrical) and the envelope of the Project Buildings in such manner as to meet the checklist criteria and certification under the Zero Energy Ready HOME ("ZERH") developed by the United States Department of Energy, based upon the criteria existing as of the Effective Date.
(c) The Developer agrees to design and build the Project Buildings to meet the required checklist criteria under the Enterprise Green Communities Criteria & Certification (the “Green Communities Checklist”), attached hereto as Exhibit D and made a part hereof. Developer shall submit a copy of the completed Green Communities Checklist criteria, along with a letter from a sustainability consultant confirming that the project documents conform with the submitted Green Communities Checklist. In addition, the Developer shall carry out the optional criteria of the Green Communities Checklist:
(i) Item 1.5 Design for Health and Well-Being Action Plan, Steps 1-6, with the caveat that the developer shall identify and engage a local community health organization, such as the Fair Haven Community Health Center, to collaborate on producing a Health and Well-Being Action Plan. Provided, if the Developer is unable to secure a local partner health organization after reasonable good faith efforts, this criterion shall be waived;
(ii) Item 1.6 Resilient Communities: Multi-Hazard Risk/Vulnerability Assessment; and
(iii) Item 5.10 Resilient Energy Systems: Critical Loads.
(d) The Developer agrees to design and install all electric heating, ventilation and air conditioning systems, hot water systems, and appliances in all of the residential units comprised within the Project.

(B) Sustainable Transportation Program. In order to promote bicycling to the ▇▇▇ ▇▇▇▇▇▇▇ ▇▇▇▇▇▇ Parcel, the Developer will provide showers and a private changing area for cyclists who work in the Building and will provide an enclosed bike storage facility. The Developer shall take a shared parking approach to the Development by limiting on-site parking to 175 spaces and by entering into an agreement with the Parking Authority for the use of parking spaces in the Temple Street Garage and the Temple Medical Garage as set forth in Section 11.2 below of and Exhibit Z to this Agreement. The Developer shall provide for electric charging of electrically powered vehicles as reasonably allocated by the Developer for any on- site parking. The Developer will discuss with Yale University and the CTtransit New Haven (operated by CDOT) the feasibility of providing bus stops adjacent to the ▇▇▇ ▇▇▇▇▇▇▇ ▇▇▇▇▇▇ Parcel.

Walnut agrees that all Walnut Projects developed within the UC-MU District will be developed so that they will be able to obtain at least one (1) Performance Point pursuant to the standards set forth in the Zoning Code’s High Performing Buildings - New Construction to LEED Standards, and that the project, once complete, will obtain LEED Certification. Should a Walnut Project fail to meet this standardobtain LEED Certification, Walnut agrees to pay a penalty to the City in accordance with the standards set forth in Section 925.06.E of the City of Pittsburgh Zoning Code.
