Common use of Commitment Notice Clause in Contracts

Commitment Notice. Promptly following the attainment by Bay Gas of satisfactory arrangements for financing, and all permits, authorizations, certificates and approvals as set forth in Section 1.1(a) and 1.1(b) consistent with the terms of this Agreement (or the waiver thereof by Bay Gas and Shipper), Bay Gas shall provide Shipper with written notice (the “Commitment Notice”) to such effect.

Commitment Notice. Promptly following the attainment by Bay Gas of satisfactory arrangements for financing, and all permits, authorizations, certificates and approvals as set forth in Section 1.1(a) and 1.1(b) consistent with the terms of this Agreement (or the waiver thereof by Bay Gas and Shipper), Bay Gas shall proceed with the necessary activity to commence the leaching of the required new storage capacity. Upon or before commencement of the leaching activity Bay Gas shall provide Shipper with written notice (the “Commitment Notice”) to such effect.
