COMMERCIAL USAGE. No part of our Harbour or Premises or any Vessel or vehicle situated therein or thereon shall be used by you for any commercial purpose, except where you have sought and obtained our prior written consent. Where this Agreement is made with a commercial operator whose Vessel is operated for hire or reward in the course of trading we reserve the right to impose further conditions and or restrictions if deemed necessary by us in the interests of good estate management.

COMMERCIAL USAGE. Only in the commercial contract, the clauses omitted from the contract shall be governed by the application of commercial usage. Contract’s test. The test of the contract may be performed by any means and not only by single documents. Effects of the contract. In case of commercial contract, the debtor is in default without any prior notice and in the laws systems requiring such notification, it can be done by any means. The principle of intentionality derives from the fact that such contract contains elements that objectively establish contact with many legal systems.

The provided instruments, effects, samples, wavetables and presets can be used for commercial or non-commercial music and audio productions without the prior permission from Kilohearts. All Kilohearts software may be used to create samples for commercial products such as sample packs and sound libraries. However, you are not permitted to redistribute samples created from any unaltered factory content, Kilohearts Content Banks, or their derivatives. Basically, be creative! Make your own sounds and don't just sample our presets and sell them on. Who would do that anyway!? You are permitted to create presets for Kilohearts software for commercial use. In fact we would love you to do that. But be careful, for presets you may use only samples and wavetables for which you hold valid commercial rights. You are permitted to use Kilohearts factory samples, wavetables and LFOs in your presets. COMMERCIAL USAGE. Only qualified professionals have the right to use the software with people suffering from a mental or physical health condition. This software may only be used as part of psychotherapy, a research project, or an intervention plan for the prevention and treatment of mental and physical disorders. The software’s buyer is responsible for making sure that only professionals with the necessary skills and professional accreditations will use the software before buying, installing or using the software, as well as throughout its use.
