Common use of Collateral Held by Warehouseman, Bailee, etc Clause in Contracts

Collateral Held by Warehouseman, Bailee, etc. If any Collateral in excess of $100,000 in the aggregate is at any time in the possession or control of a warehouseman, bailee or any agent or processor of such Obligor and the Collateral Agent so requests (i) notify such Person in writing of the Collateral Agent’s security interest therein, (ii) instruct such Person to hold all such Collateral for the Collateral Agent’s account and subject to the Collateral Agent’s instructions and (iii) use reasonable best efforts to obtain a written acknowledgment from such Person that it is holding such Collateral for the benefit of the Collateral Agent.

Collateral Held by Warehouseman, Bailee, etc. If any Collateral in excess of valued at $100,000 in the aggregate or more is at any time in the possession or control of a warehouseman, bailee or any agent or processor of such Obligor and the Collateral Agent so requests Obligor, (i) notify the Agent of such Person in writing of the Collateral Agent’s security interest thereinpossession, (ii) instruct notify such Person to hold all such Collateral for of the Collateral Agent’s account and subject to the Collateral Agent’s instructions and (iii) use reasonable best efforts to obtain a written acknowledgment from such Person that it is holding such Collateral 's security interest for the benefit of the Collateral AgentLenders in such Collateral, and (iii) assist the Agent in obtaining executed Acknowledgment Agreements from such Person.

Collateral Held by Warehouseman, Bailee, etc. If any Collateral with a value in excess of $100,000 in the aggregate 250,000 is at any time in the possession or control of a warehouseman, bailee or any agent or processor of such Obligor and the Collateral Agent so requests (i) notify such Person in writing of the Collateral Agent’s security interest therein, (ii) instruct such Person to hold all such Collateral for the Collateral Agent’s account and subject to the Collateral Agent’s instructions and (iii) use commercially reasonable best efforts to obtain a written acknowledgment from such Person that it is holding such Collateral for the benefit of the Collateral Agent.
