Common use of Collateral Access and Control Agreements Clause in Contracts

Collateral Access and Control Agreements. The Administrative Agent shall have received each (i) Collateral Access Agreement required to be provided pursuant to Section 4.13 of the Security Agreement and (ii) Deposit Account Control Agreement required to be provided pursuant to Section 4.14 of the Security Agreement.

Collateral Access and Control Agreements. The To the extent applicable, the Administrative Agent shall have received each (i) Collateral Access Agreement required to be provided pursuant to Section 4.13 of the Security Agreement and (ii) Deposit Account Control Agreement, Securities Account Control Agreement and Commodity Account Control Agreement required to be provided pursuant to Section 4.14 of the Security Agreement.

The Administrative Agent shall have received each (i) Collateral Access Agreement and Deposit Account Control Agreement that is required to be provided pursuant to Section 4.13 of the Security Agreement and (ii) Deposit Account Control Agreement required to be provided pursuant to Section 4.14 of the each Security Agreement.

Collateral Access and Control Agreements. The Administrative Agent shall have received each (i) each Collateral Access Agreement required to be provided pursuant to Section 4.13 of the Security Agreement and (ii) each Deposit Account Control Agreement required to be provided pursuant to Section 4.14 of the Security Agreement, in each case, solely to the extent required to be provided on or prior to the Effective Date.

Collateral Access and Control Agreements. The Administrative Agent shall have has received each (i) each Collateral Access Agreement required to be provided pursuant to Section 4.13 of the Security Agreement and (ii) each Deposit Account Control Agreement required to be provided pursuant to Section 4.14 of the Security Agreement; provided that, the parties hereto agree that such agreements may be delivered any time within 60 days of the Effective Date and the Administrative Agent may in its sole discretion extend such time period for delivery upon written notice to the Borrower Representative.

The Administrative Agent shall have received each (i) subject to Section 5.13, each Collateral Access Agreement required to be provided pursuant to Section 4.13 of the Security Agreement and (ii) subject to Section 5.13, each Deposit Account Control Agreement and Government Receivables Account Agreements required to be provided pursuant to Section 4.14 of the Security Agreement.

Collateral Access and Control Agreements. The Administrative Agent shall have received each (i) Collateral Access Agreement required to be provided pursuant to Section 4.13 5.12 of the Security Guarantee and Collateral Agreement and (ii) Deposit Account Control Agreement required to be provided pursuant to Section 4.14 5.10 of the Security Guarantee and Collateral Agreement.

The Administrative Agent shall have has received each (i) each Collateral Access Agreement required to be provided on the Effective Date pursuant to Section 4.13 of the Security Agreement and (ii) each Deposit Account Control Agreement (as defined in the Security Agreement) required to be provided on the Effective Date pursuant to Section 4.14 of the Security Agreement.

The Administrative Agent shall have received each (i) Collateral Access Agreement required to be provided prior to the Effective Date pursuant to Section 4.13 of the Security Agreement and (ii) Deposit Account Control Agreement required to be provided prior to the Effective Date pursuant to Section 4.14 of the Security Agreement.

The US Administrative Agent shall have received each (i) Collateral Access Agreement required to be provided pursuant to Section 4.13 of the Security Agreement and (ii) Deposit Account Control Agreement required to be provided pursuant to Section 4.14 of the Security Agreement.

The Except as otherwise provided in the Post-Closing Letter Agreement, the Administrative Agent shall have received each (i) Collateral Access Agreement and Deposit Account Control Agreement that is required to be provided pursuant to Section 4.13 each Security Agreement (provided the foregoing shall be deemed to be satisfied if the Administrative Agent receives copies of such agreements which may be in favor of the Security Agreement and (ii) Deposit Account Control Agreement required to be provided pursuant to Section 4.14 of the Security AgreementResigning Agent).

The Administrative Agent shall have received each of (i) a Collateral Access Agreement for the Borrower's headquarters and (ii) deposit account control agreements required to be provided pursuant to Section 4.13 of the Security Agreement and (ii) Deposit Account Control Agreement required to be provided pursuant to Section 4.14 of the Security Agreement.

The Administrative Agent shall have received each (i) Collateral Access Agreement required to be provided pursuant to Section 4.13 of the Security Agreement Agreement, and (ii) Deposit Account Control Agreement required to be provided pursuant to Section 4.14 of the Security Agreement.

The Administrative Agent shall have received each (i) Collateral Access Agreement required to be provided pursuant to Section 4.13 of the any Security Agreement (including without limitation, a Collateral Access Agreement with respect to each Distribution Center) and (ii) Deposit Account Control Agreement required to be provided pursuant to Section 4.14 of the any Security Agreement.

Collateral Access and Control Agreements. The Administrative Agent shall have received each (i) each Collateral Access Agreement required to be provided pursuant to Section 4.13 of the Security Agreement and (ii) subject to Section 5.13, each Deposit Account Control Agreement and Government Receivables Account Agreements required to be provided pursuant to Section 4.14 of the Security Agreement.

The Administrative Agent shall have received each (i) each Collateral Access Agreement required to be provided pursuant to Section 4.13 of the Security Agreement and (ii) each Deposit Account Control Agreement and Securities Account Control Agreement (each such term as defined in the Security Agreement) required to be provided pursuant to Section 4.14 of the Security Agreement.. The Administrative Agent shall have received each (i) Collateral Access Agreement required to be provided pursuant to Section 4.13 of the Security Agreement and, to the extent not obtained, the Administrative Agent shall impose a rent or charges Reserve for each applicable location in accordance with the definition of Eligible Inventory; and (ii) Deposit Account Control Agreement required to be provided pursuant to Section 4.14 of the Security Agreement.

The Administrative Collateral Agent shall have received each (i) Collateral Access Agreement required to be provided pursuant to Section 4.13 of the Pledge and Security Agreement and (ii) Deposit Account Control Agreement required to be provided pursuant to Section 4.14 of the Pledge and Security Agreement.

Collateral Access and Control Agreements. The Administrative Agent shall have received each (i) Collateral Access Agreement required to be provided pursuant to Section 4.13 of the Security Agreement Collateral Documents and (ii) Deposit Account Control Agreement required to be provided pursuant to Section 4.14 of the Security AgreementCollateral Documents, in each case as required to be delivered on the Effective Date.

Collateral Access and Control Agreements. The Administrative Agent shall have received each (i) Collateral Access Agreement required to be provided pursuant to Section 4.13 5.13 of the Security Guarantee and Collateral Agreement and (ii) Deposit Account Control Agreement required to be provided pursuant to Section 4.14 8.1 of the Security Guarantee and Collateral Agreement.

The Administrative Agent shall have received each of (i) the Collateral Access Agreement Agreements required to be provided pursuant to Section 4.13 of the Security Agreement and (ii) Deposit Account Control Agreement the deposit account control agreements required to be provided pursuant to Section 4.14 of the Security Agreement.
