CMO Agreement. POZEN covenants and agrees to use Commercially Reasonable Efforts to ensure that all Validation Batches shall be Manufactured by or on behalf of POZEN in compliance in all material respects with the then-current specifications for the Initial Products, cGMPS and Applicable Law.
