Clause 40. 1.1 above arising (whilst always recognising that the BBC cannot bind, and may not necessarily be in a position to influence the actions of, any potential future Licensing Authority) the BBC will make all reasonable efforts to arrange (with the consent of the Contractor) for the novation of this Agreement to any replacement Licensing Authority; and
Clause 40. 1.1 above shall not apply to terms of this Agreement designated as Commercially Sensitive Information which in relation to Commercially Sensitive Information shall, subject to Clause 40.2 below, be kept confidential for the relevant periods specified in Schedule 5 (Commercially Sensitive Information).
Clause 40. 6.2 applies to and in respect of any annual leave (except so much, if any, as has already been taken) whether or not the employee concerned continues to be entitled (apart from this clause) to take it, and so applies as if the employee’s right to take it had accrued immediately before the date of the termination of the employee’s employment.
