Common use of Class Notice Clause in Contracts

Class Notice. The Class Notice shall provide for a right of exclusion, as set forth in Sections II(E)(3) and (4). The Class Notice shall also provide for a right to object to the proposed Settlement. The timing of a motion to direct or approve Class Notice of this Settlement Agreement shall be in the discretion of Co-Lead Counsel, and may be combined with class notice of other settlements in this Action, provided, however, that prior to filing such a motion to approve Class Notice, Co-Lead Counsel shall provide Settling Defendants’ Counsel with a draft of such motion and shall consider in good faith any reasonable and timely proposed edits by Settling Defendants’ Counsel.
