Class Members' Claims Clause Samples
Class Members' Claims. Because of the Approval Order, the Plaintiffs and each Class Member shall be deemed to have, and by operation of the Approval Order shall have, released, waived, and discharged the Released Parties from his, her, or its Released Claims.
Class Members' Claims. Upon the Effective Date of the Settlement, and except for the rights and entitlements created by this Settlement, including those under Section II herein, the Plaintiffs and each Class Member shall be deemed to have, and by operation of the Final Order and Judgment shall have, released, waived, and discharged the Released Parties from his, her, or its Released Claims as defined above, except with respect to claims that qualify for the Arbitration Program. This release, and the rights and entitlements created by this Settlement, including those under Section II herein, will run with the vehicle if the Class Member sells the Class Vehicle.
Class Members' Claims. The Class Representative asserts that his claims have merit in regards to the putative Class Members, and Defendants disagree. The claims in this Agreement are genuinely disputed, and the Parties agree that the provisions of Labor Code section 206.5 do not apply to the consideration in this Settlement Agreement.
