City Commitments. 14.1 The City will expedite its review of MUP applications for development of the Sites. 14.2 The City will apply the terms of this Agreement to future developers and owners of the five Sites. 14.3 Subject to applicable law, City funding policies and guidelines, and City appropriation, the City will provide financial resources, such as the Housing Levy, to help fund Affordable Housing on Site B-North.
City Commitments. To facilitate ▇▇▇▇▇▇▇▇▇’s ability to develop plans for the Project and to commit to a Project timeline, the City agrees to the following commitments should the Project proceed:
City Commitments. The City specifically covenants and agrees: 6.1 To provide the Contractor quiet use and enjoyment of the leased premises. 6.2 To review the delivery of services provided by the Contractor and cooperatively work with the Contractor to provide assistance, leadership and resource materials to ensure that an acceptable level of service delivery is maintained at the Cosmopolitan Lodge. 6.3 To work with the Contractor in reviewing and setting annual rental fees with the objective of generating sufficient revenues through the Cosmopolitan Lodge in a manner consistent with the City’s rates and fees structures at similar facilities. 6.4 To work with the Contractor on any renovations approved by the Director. 6.5 To be responsible for any and all small and large equipment purchase(s) that are approved for use in the operation of the Knotty Pine Bistro by the Director.
City Commitments. City agrees to: 1. Provide timely review and comments on stormwater plans and reports to assist with meeting Partner project delivery times; within 14 days of receiving submittals, if possible, and communicate with project teams if timelines must be modified. 2. Accept long-term operation and maintenance responsibility for stormwater management facilities that manage public stormwater (i.e. combined runoff from schools and adjacent public streets and/or neighborhoods) in the City’s jurisdiction, such as Century HS water quality swale retrofit. 3. Allow enhancement associated with Service Provider Letter No. 18-002531 to be completed by County with the Water Quality Swale Improvement project at Century High School. Issue HSD permits for the Modular Classroom (PUP18-00059) without a Vegetated Corridor Enhancement landscaping plan. 4. Recognize that a programmatic, sub-basin approach to stormwater management projects may take longer to implement than smaller onsite projects, but also have a greater overall community benefit. City will work with CWS to issue permits for County road projects and HSD projects that are dependent on planned partnership projects within reasonable timeframes. In some cases the required stormwater management projects may lag HSD construction projects, but this will be reconciled programmatically with the overall portfolio of projects, as described in County and HSD Commitments.
City Commitments a) City will make the following public improvements in the area (subject to the expected funding): i. Repair the retaining wall along Lincoln St. ii. Make (or have made) road improvements on Main St. iii. Make road improvements on Lincoln St. iv. Make modifications at the ▇▇▇▇▇▇▇, ▇▇▇▇ and Main St. intersection v. Rebuild the sidewalks on Lincoln St b) The City will amend the ground lease agreement dated June 12, 2015 by modifying the dates in order to accommodate the new construction schedule. The significant business terms in the agreement will not change unless both Parties agree. c) City will actively work with LHL, and assist it as needed, during the permit modification and construction period. d) City will provide a Credit Enhancement to LHL in the amount of seven hundred fifty thousand ($750,000.00). The amount will be paid in five (5) annual increments of one hundred fifty thousand ($150,000.00) beginning during the City’s first fiscal year following the substantial completion of the Project . The City shall make the annual incremental payments to LHL within 30 days following each tax payment date or the date payment is actually received by the City from LHL, whichever is later.
City Commitments. 4.1. City shall consider in good faith and timely process any application for approval by the City Council and Planning Commission of the proposed development of the ▇▇▇▇▇-South ▇▇▇▇▇▇▇▇ Specific Plan area, including the Rezoning Approvals, which would, if approved, allow a total of 119 residential units on the Planning Area 9 Property, the Vesting Tentative Map and vacation of the Vacation Areas as depicted in Exhibit A – Public Right-Of-Way Abandonment Area 8. 4.2. City shall consider in good faith that Planning Area 9 will be rezoned and designated Medium Density Residential zoning as part of ▇▇▇▇▇-South ▇▇▇▇▇▇▇▇ Specific Plan, with an allocated 119 residential units. 4.3. City shall consider in good faith the Vesting Tentative Map. 4.4. All development in Planning Area 9 will be subject to current City development policies and the FEIR Mitigation Monitoring and Reporting Program. Infrastructure necessary to serve the development will be the responsibility of the developer to install. 4.5. All in-tract and interior streets, landscaping, and storm drainage will be the maintenance responsibility of the developer until transfer to the project homeowners association at 4.6. The remaining portion of Linne Road left after vacation of the Linne Road Vacation Area will be the maintenance responsibility of the developer until transfer to the project homeowners association at which point the responsibility shall shift to the homeowners association. 4.7. All development and newly subdivided lots in Planning Area 9 will be subject to annexation into the City’s existing Community Facilities District No. 2005-01 (Public Services District). 4.8. Planning Area 9 is also subject to a School Site overlay land use designation, under Policy 2.1.6 of the ▇▇▇▇▇-South ▇▇▇▇▇▇▇▇ Specific Plan. If the Owner and Paso ▇▇▇▇▇▇ Joint Unified School District have not entered into a binding agreement providing for acquisition of all or a portion of Planning Area 9 for use as a school site by the Paso ▇▇▇▇▇▇ Joint Unified School District before the earliest of the date the City sets a public hearing for consideration of the entitlements for development of Planning Area 9 or January 31, 2019, or if the Paso ▇▇▇▇▇▇ Joint Unified School District otherwise disclaims interest in the school site in writing to the Owner and City, then the Owner may develop Planning Area 9 for residential uses, subject to all other applicable provisions of the ▇▇▇▇▇-South-▇▇▇▇▇▇▇▇ Specific Plan and governing la...
City Commitments a. The establishment of a 20 year Credit Enhancement Agreement with Saxon that will: i. For years 1-5, pay taxes to the City of $255,000 in Year 1, escalating at 2% in Years 2-5 ii. For Years 6-20, the City will retain 65% of taxes paid. b. Coordinate Master Planning activities with key departments, committees, and agencies to insure a sound planning process and completion within the specified period above. c. Based on the Master Planning process, make recommendations to the Planning Board and City Council for zoning adjustments, including but not limited to, height restrictions, reduction in yard setbacks, or adjusting density requirements, consistent with the standards of the Saxon project. d. To assist Eon Entities and an appropriate developer in obtaining financing in support of affordable housing development, including the consideration of TIF funds when deemed necessary to complete the project.
City Commitments. 1) The City shall pay for or provide the City Manager reimbursement for all actual and necessary business expenses. The City shall provide the City Manager a City credit card to charge appropriate and lawful business expenses, subject to all City-adopted expense reimbursement policies and requirements. 2) Subject to the limitations contained in the City's annual general fund operating budget for such expenditures, the City agrees to pay the following: (a) Professional dues and subscriptions on behalf of the City Manager which are necessary for the City Manager's continuation and full participation in national, regional, state, or local associations and organizations necessary and desirable for the good of the City, and for the City Manager's continued professional participation and advancement. This includes the International City Management Association ("ICMA") and the California City Management Foundation ("CCMF"); (b) Travel and subsistence expenses of the City Manager to pursue official and other functions for the City, and meetings and occasions to continue the professional development of the City Manager, including, but not limited to, national, regional, state, and local conferences, and governmental groups and committees upon which the City Manager serves as a member; and (c) Travel and subsistence expenses of the City Manager for short courses, institutes and seminars that are necessary for the good of the City or for the professional development of the City Manager. 3) The City recognizes the desirability of representation in and before local civic and other organizations, and the City Manager is authorized to become a member of civic clubs or organizations, for which the City shall pay membership dues to the extent that such expenditures are included in the annual operating budget.
City Commitments. (1) The City shall provide the City Manager with the compensation, incentives and benefits, specified elsewhere in this Agreement. (2) The City shall provide the City Manager with a private office, secretary, staff, office equipment, supplies, city auto and a cell phone, and all other facilities and services as needed and appropriate for the performance of City Manager's duties. (3) The City shall pay for or provide reimbursement for all reasonable and lawful business expenses of the City Manager incurred as a result of performing the duties of the City Manager. The City shall provide the City Manager a City credit card to charge appropriate and lawful business expenses. Lawful business expenses shall be supported by receipts. (4) The City agrees to pay the professional dues and subscriptions on behalf of the City Manager which are necessary for the City Manager's continuation and full participation in national, regional, state, or local associations and organizations necessary and desirable for the good of the City, and for the City Manager's continued professional participation and advancement and as approved by the City Council in the City's annual budget. At a minimum, this shall include any annual professional dues for membership with the International City Manager's Association ("ICMA") and the League of California Cities. (5) The City agrees to pay the travel and subsistence expenses of the City Manager to pursue official and other functions for the City, and meetings and occasions to continue the professional development of the City Manager, including, but not limited to, national, regional, state, and local conferences, and governmental groups and committees upon which the City Manager serves as a member and as approved by the City Council in the City's annual budget. At a minimum, this shall include attendance at the annual ICMA conference and the Annual League of California Cities conference. (6) The City also agrees to pay reasonable costs for the travel and subsistence expenses of the City Manager for short courses, institutes and seminars that are necessary for the good of the City or for the professional development of the City Manager and as approved by the City Council in the City's annual budget. (7) The City Manager shall prepare and submit to the City Council on an annual basis, or upon request of the Council as part of a performance evaluation, a report detailing the expenses and costs related to Subsections (4), (5) and (6). City Commitments a. The City will appoint an Ombudsman that will serve as a point of contact for Franchisee, and who will work with Franchisee to streamline the processes for applying for permits and other authorizations that Franchisee may require from the City to complete the upgrades to the ▇▇▇▇▇▇▇▇ System. b. Promptly after the Effective Date, City will submit a formal filing to withdraw as a party from the Commission's Application proceeding, including notice of the withdrawal of its prepared testimony. The City will submit a copy of this Agreement as an exhibit to its filing to withdraw as a party, but will not make any other filings other than its withdrawal in that proceeding, or subsequently seek to intervene or otherwise participate in that proceeding so long as Charter: (a) does not substantially modify the proposed Transaction in a manner that is inconsistent with this Agreement or materially adverse to the City-specific interests identified in the City's December 8, 2105 motion to intervene; or (b) take any additional action in that proceeding that is materially adverse to the City-specific interests identified in such motion; or (c) take any action in any proceeding that is inconsistent with this Agreement. Provided, that, if the Application is not approved or the Transaction does not close for any reason, the foregoing obligations under Section 2(b) shall no longer apply, and, without limitation, City may commence or participate in any proceeding to require Franchisee or Charter to upgrade its ▇▇▇▇▇▇▇▇ System.
