Charging Rate. During the Delivery Term, Seller shall maintain the Storage Facility with the ability to charge at a rate of greater than [•] MW per hour (the “Guaranteed Charging Rate”). If the Storage Facility does not satisfy the Guaranteed Charging Rate as determined by the most recent Storage Contract Capacity Test, then Seller will be required to place the Storage Facility into an Unplanned Outage and repair the Storage Facility such that it satisfies the Guaranteed Charging Rate within thirty (30) days.

  • Undercharging and Overcharging (a) If we undercharge you for any reason, then we can require you to make a correcting payment. However, if you are a customer who consumes not more than 160 MWh of electricity per annum and we undercharge you due to an error, defect or default for which we or Western Power Networks are responsible, we can only require you to make a correcting payment for amounts undercharged in the 12 months prior to the date that we advise you that you have been undercharged and, if you are a residential customer, we will offer you the option to pay the correcting payment by instalments. If you are a customer who consumes more than 160 MWh of electricity per annum, then we can recover the amount of any undercharge subject to and in accordance with applicable laws, including the Energy Operators (Powers) Xxx 0000 (WA).

  • Overcharging (a) Where you have been overcharged by less than $50, and you have already paid the overcharged amount, we must credit that amount to your next bill.

  • Interest Rate The LHIN may charge the HSP interest on any amount owing by the HSP at the then current interest rate charged by the Province of Ontario on accounts receivable.

  • Undercharging (a) If we have undercharged you, we may recover the undercharged amount from you. If we recover an undercharged amount from you:

  • Base Rate The greater of (a) the variable annual rate of interest announced from time to time by Agent at Agent's Head Office as its "prime rate" or (b) one-half of one percent (0.5%) above the Federal Funds Effective Rate (rounded upwards, if necessary, to the next one-eighth of one percent). The Base Rate is a reference rate and does not necessarily represent the lowest or best rate being charged to any customer. Any change in the rate of interest payable hereunder resulting from a change in the Base Rate shall become effective as of the opening of business on the day on which such change in the Base Rate becomes effective, without notice or demand of any kind.

  • Base Rates Attached to and made a part of this Agreement is Appendix A which sets forth the straight-time hourly rates for all employees covered by this Agreement.

  • Parking Rates A. For the term of this agreement, the parties agree that the State may increase parking rates in existing owned or leased lots, in urban congested areas, no more than $20 per month above the current rate, charged to employees in specific locations where they park. Congested urban areas are areas such as Sacramento, San Francisco Bay, Fresno, Los Angeles, San Bernardino, Riverside, and San Diego areas. Every effort shall be made to provide employees sixty (60) days but no less than thirty (30) days notice of a parking rate increase. The State shall not increase rates for existing parking lots where employees do not currently pay parking fees. Rates at new lots administered or leased by the State will be set at a level comparable to rates charged for similar lots in the area of the new lot, e.g., rates for open lots shall be compared to rates for open lots, rates for covered parking shall be compared to rates for covered parking.
