Charge for Effluent Clause Samples

Charge for Effluent. For ten (10) years following the initial delivery of A+ effluent to the golf course lake serving at the permitted retention area, Town will deliver the effluent at no charge to the Van Tuyl Entities. Thereafter, the Town may charge for effluent a rate of $25 per acre-foot adjusted annually from the date of initial effluent delivery of A+ effluent based on the rate from the All Items Consumer Price Index All Urban Consumers, U.S. City Average (1982-84 = 100), which is published by the U.S. Department of Labor, Bureau of Labor Statistics (“CPI”).
