Common use of Changes Requiring Prior Approval Clause in Contracts

Changes Requiring Prior Approval. Any change which substantially modifies the Project Facilities as specified in the Ohio EPA approved Facilities Plan and Final Permit to Install or Final Plan Approval (when applicable) or alters the direct or indirect impact of the Project Facilities upon the environment must be incorporated into a Change Order. One copy of the Change Order is to be submitted to Ohio EPA – DEFA for review and confirmation of the acceptability of the change. "Prior to execution" means before the change order is signed by the LHD. Ohio EPA will review the Change Order and inform the LHD of the technical, environmental and operational acceptability of the change, and give the LHD permission to proceed with the proposed work. All Other Changes Change orders not requiring prior approval as described above must be submitted to the Ohio EPA – DEFA within one (1) month of the time at which they are approved by the LHD.
