Change in Availability Notice. In the event that the Seller is unable to provide the Commitment Level at any time (a “Change in Availability”), Seller shall use commercially reasonable efforts to notify Buyer of any Change in Availability as soon as practical after the occurrence of such change. Seller’s Notice to Buyer of Change in Availability shall include a written estimate of the expected deviation from the Commitment Level, its expected duration, the Delivery Point where the Change in Availability is occurring, and the causes of such Change in Availability. Seller shall also notify Buyer in writing upon the return of the Commitment Level availability. The Change in Availability Notice shall be for information purposes only and shall not excuse or release Seller from its obligations under this Agreement.

In the event that the Seller is unable to meet the Commitment Level requirements as set forth in this Agreement (a “Change in Availability”), Seller shall use commercially reasonable efforts to notify Buyer of any Change in Availability as soon as practical after the occurrence of such change. Buyer’s notice of Change in Availability shall include a written estimate of its expected duration and the causes of such Change in Availability. Seller shall also notify Buyer in writing upon the return of the DR availability to normal levels so as to meet the Commitment Level requirements set forth in this Agreement. The Change in Availability Notice shall be for information only and shall not release Seller from its obligations under this Agreement.
