Certiorari Proceeding Sample Clauses

A Certiorari Proceeding clause defines the process by which a higher court reviews the decision of a lower court at its discretion. Typically, this clause outlines the conditions under which a party may petition for certiorari, the timeline for filing such a petition, and any limitations on the issues that can be raised. Its core function is to provide a structured mechanism for appellate review, ensuring that only significant legal questions or errors are considered by the higher court, thereby promoting judicial efficiency and consistency in the application of the law.
