If the SBE participation goal is not met, and if this form, along with compelling documentation detailing the good faith efforts made to meet the goal, is not completed and returned with the proposal, the proposal shall be deemed non-responsive and rejected. Even if bidder’s SFMTA SBE Form No. 1 indicates the SBE goal has been met, bidders should still submit the following information to protect their eligibility for the contract. This is because SFMTA’s Contract Compliance office may determine that bidders have not met the goal for various reasons, e.g., if an SBE subcontractor submitted by the prime contractor was not SBE/DBE/LBE certified on the proposal due date. In these cases, SFMTA’s SBE Form No. 1 will not normally provide sufficient information to demonstrate that the bidder made good faith efforts. Please supply information regarding the following:
