Common use of Certain Transponder-Related Definitions Clause in Contracts

Certain Transponder-Related Definitions. As used in this Agreement, (i) "Owner' shall include the actual owner of a Transponder, including HCG if there remain any unsold Transponders, or any permitted assignee of such owner's Transponder, or any lessee or licensee of HCG's (including, without limitation, Lessee) entity to which HCG (or any affiliate of HCG) provides service using the Transponders; (ii) the term "purchase" shall include the execution of an agreement with HCG for a lease of Transponders for a term equal to at least 75% of the Satellite's Useful Commercial Life (as Defined in Section 2.01 below); and (iii) "affiliate" shall mean, with respect to any entity, any corporation or other entity controlling or controlled by or under common control with such entity.
