CC Container System. Parties acknowledge that the CC Containers concerned in the Agreement are part of the CC Container System. The CC Containers are identified with the Identification Marks.

During the term of the Agreement CC reserves the right to exchange the CC Containers with components and fittings of improved design and make corresponding adjustments of the pricelist. 11.5. Parties agree that CC is at all times in the interest of the CC Container System entitled to reclaim all CC Containers from any Other Contracting Party in the event any and/or all agreement(s) with the Other Contracting Party are terminated. The Customer will assist and offer its full cooperation in reclaiming the CC Containers and provide with the required information and render assistance for that purpose.

In order to realize a fair distribution of costs connected to the repair and maintenance of shelves, CC will require the Customer to maintain in its overall contract position a minimum base:shelf ratio of 1:3. CC can decide, if the Customer can deliver compelling proof of the use of a ratio below 1:3 CC, to allow the Customer to maintain a lower base:shelf ratio. 11.5. During the term of the Agreement CC reserves the right to change the CC Containers with components and fittings of improved design and make corresponding adjustments of the pricelist. CC can determine to reserve the ownership of these improved components. 11.6. Customer appoints CC as administrator of the CC Container System (community of property of CC Containers) providing CC authorisation to perform management actions on behalf of the community of property. Parties agree that CC is at all times in the interest of the CC Container System entitled to claim the handing over of all CC Containers wherever they are stored or held by anyone, including in the situation of bankruptcy of either the Customer or any Other Contracting Parties or third party which holds CC Containers. The management activities of CC as administrator of the CC Container System shall also include all rights necessary in or outside bankruptcy proceedings to take possession over the CC Containers, including the power of attorney to file actions (within such bankruptcy proceedings) in name and or on behalf of the Customer and/or community of property that is established. 11.7. The Customer or bankruptcy receiver will assist and offer its full cooperation in the handing over of CC Containers and provide with the required information and render assistance for that purpose without asking for compensation up front. For the avoidance of doubt the Customer holding the CC Containers shall be considered to hold the CC Containers on behalf of CC or the community of property and shall not alter its title on the property...
