Caucus Sessions Clause Samples

The Caucus Sessions clause establishes the right of parties involved in a dispute resolution process, such as mediation, to meet privately with the neutral facilitator without the other party present. In practice, this means that each side can discuss sensitive issues, explore settlement options, or clarify their positions confidentially with the mediator. This clause helps foster open communication, encourages candid discussion, and can facilitate more effective problem-solving by allowing parties to express concerns or interests they may not wish to share in joint sessions.
