Caretaking Sample Clauses
The Caretaking clause establishes the responsibility of one party to maintain, protect, or manage certain property, assets, or interests on behalf of another. In practice, this may require the caretaker to perform regular inspections, handle necessary repairs, or ensure the property is kept in good condition during a specified period, such as during a lease or pending a sale. Caretaking. To maintain and keep clean all public areas in the Building, but, except as to the obligations to cause such maintenance and cleaning to be done, the Landlord shall not be responsible for any act of omission or commission or for any negligence on the part of the person or persons employed to perform such work, nor shall the Landlord have any responsibility to provide any such services with the Premises. Caretaking. All cleaning and caretaking of the Subleased Premises shall be carried out by the Tenant at the Tenant's expense including, without restriction, the picking up and removal of all trash and litter from the Subleased Premises on a regular basis and as and when necessary to maintain a clean and tidy condition.
Caretaking. (a) The Landlord covenants to provide cleaning and caretaking services and in its sole discretion to provide such additional cleaning and caretaking services as may be requested by the Tenant from time to time, but the Landlord shall not be responsible for any omission or act of omission on the part of the person or persons employed or retained to perform such work, or for any loss thereby sustained by the Tenant, the Tenant's servants, agents, invitees or others unless such omission or act of omission constituted the gross negligence or wilful misconduct of the Landlord, its agents, servants, employees or others for whom it is in law responsible. The Tenant acknowledges that the Landlord will be relieved from the foregoing obligation in respect to any part of the Leased Premises to which access is not granted to the person or persons employed or retained to perform such work.
(b) The Tenant covenants to pay to the Landlord as Additional Rent the cost of providing the additional caretaking and cleaning services mentioned in Subsection (a) hereof. In the event that such costs form an integral part of caretaking and cleaning services provided for portions of the Project in addition to the Leased Premises, the Landlord, acting reasonably, shall make an allocation of that portion of such costs which is reasonably attributable to the Leased Premises. In the event of any dispute by the Tenant of the amount of such costs, an opinion of the Landlord's Accountant shall be conclusive as to the amount thereof for any period to which such opinion relates.
(c) The Tenant covenants to leave the Leased Premises in a reasonably tidy condition at the end of each day for the purpose of permitting the performance of the Landlord's caretaking and cleaning services hereinbefore referred to.
Caretaking. Tenants will be responsible for all janitorial and cleaning responsibilities for the Premises and shall maintain the Premises in a neat and tidy condition.
