Capitalization Increase. Borrower does not have sufficient authorized common stock to cover the full amount of Vested Share Rights that will accrue through scheduled maturity of the Loan. Borrower covenants to use its best efforts to amend its certificate of incorporation by March 31, 2016 to authorize sufficient additional common stock to cover the full amount of Vested Share Rights that will accrue through the scheduled maturity of the Loan (the “Capitalization Increase”).
