Common use of Capital Projects Clause in Contracts

Capital Projects. (a) The selection of all design professionals and contractors for capital projects shall be made by Lessor, after consultation with Lessee. (b) Lessor may require that all contracts in connection with capital projects be subject to competitive bidding procedures reasonably acceptable to Lessor. Lessor shall also have the right to review and approve all contract bids, whether competitively bid or not. Lessor may also retain, at its sole cost and expense, an inspecting architect or engineer to monitor costs, time, quality and performance for all capital projects.
